ISLAMABAD: Chief Justice Qazi Faez Isa has said that the Chairman Election Commission and its members deserve respect but unfortunately some judges have disparaging remarks.
Chief Justice Qazi Faez Isa has delivered a decision regarding recounting of votes in three National Assembly constituencies in Punjab by the Supreme Court.
The majority decision says that the Election Commission is a constitutional body and the Chairman and members of the Election Commission deserve respect. However, some judges unfortunately overlook this aspect and speak disparagingly, while every constitutional institution and incumbent deserves respect. An institution’s credibility is enhanced when it fulfills its responsibilities within the framework of respect.
The written decision notes that requests for a recount of votes in the three constituencies were received on February 9 and 10. On 5 August 2023, an amendment to the Electoral Act 2017 gave the returning officer the power to recount votes. When the case reached the High Court, this change was in place, but the High Court did not consider subsection 5 of section 95.
