Islamabad: Chief Justice Kazi Faez Isa said on Wednesday that he will not allow the Supreme Court to interfere in the proceedings and that he is “seriously” the letter of the Islamabad High Court judge.
Further, the Chief Justice pointed out that even the Supreme Judicial Council does not refer to the Supreme Court.
CJP Jesus’ statement came during the hearing of a suo motu notice passed by a judge of the Islamabad High Court (IHC) in a letter referring to the intelligence agency’s complaint of interference in the judicial process.
DK broadcast live.
“The judge must be convinced that there is danger,” CJP Isa said in the hearing.
The Chief Justice said that no other court can exercise its discretionary powers.
“This abominable court will exercise this power itself.”
“There is no tolerance for judicial independence,” the chief justice said.
However, the judge asked the lawyers to seek suo motu notice in the above-mentioned matter, not a single meeting of the full court was held in four years.
“The full court performs administrative, not judicial, functions.”
“My colleagues and we will fight any attack on the independence of the judiciary,” the Chief Justice said.
He also said: “Whoever has an agenda … should be the supreme judge. We will not pressure; we work administratively,” he said.
Following the letter from the IHC judge in the AGP hearing, the CJP included a meeting between Isa and the judge.
The Chief Justice replied to the AGP: “We do not meet at home, we do not meet in the room, hiding from the executive body. We hold meetings as administrators, tell us the difference between the law.
The AGP then informed the court about the government’s decision to appoint former Chief Justice Tasadduq Hussain Jilla as the head of the investigation team.
The CJP also did not like the controversy surrounding Justice (former) Jilani on social media.
The Chief Justice then said that the SC has no power to create a commission under the constitution.
“The authority to establish the commission is with the government, we have consulted and given its name,” he said.
Meanwhile, the AGP said the law does not allow the government to interfere in the investigation.
The AGP then commented on the independence of the judiciary and said, “I believe that the federal government will not do any action that will affect the independence of the judiciary”.
Calling social media “a new epidemic”, JJP spoke of the pressure letter and subsequent events.
At the beginning of the hearing, CJP Isa said that the three-member committee will now decide the case and the will of the Chief Justice is no longer relevant.
JJP was upset about the petition being published in the media before he was brought to court. He also expressed his displeasure with the lawyers who pressured the SC to take suo motu notice.
“Is it pressure? “I don’t feel pressured by anyone,” he said.
CJP Isa said lawyers seeking suo motu notice should give up legal practice.
The AGP said after his court appearance that the government stands by the independence of the judiciary.
Attorney General of Pakistan Mansoor Usman Awan started his argument on this issue. DK sent him a message to appear on the bench.
